No transfer of Your Personal Data will take place to an organization or a country unless there are adequate controls in place including the security of Your data and other personal information as stipulated by the GDPR.
3.6 Opting “IN” Or “OUT”
An individual may opt to not have us collect their Personal Information. This may prevent us from offering them some or all of our services and may terminate their access to some or all of the services they access with or through us. They will be aware of this when the following privacy principles apply to us:
- Opt In. Where the individual will have the right to choose to have information collected and/or receive information from us; or
- Opt Out. Where relevant, the individual will have the right to choose to exclude himself or herself from some or all collection of information and/or receiving information from us. 3.7.1 Business Transactions If the Company or Data Controller is involved in a merger, acquisition or asset sale, Your Personal Data may be transferred. We will provide notice before Your Personal Data is transferred and becomes subject to a different Privacy Policy.
3.7.2 Law enforcement
Under certain circumstances, the Company or Data Controller may be required to disclose Your Personal Data if required to do so by law or in response to valid requests by public authorities (e.g. a court or a government agency).

4. Detailed Information on the Processing of Your Personal Data
Trendspek conducted a DPIA for this project due to the scope of its data processing activities. As an Australian-based company providing on-premises software and cloud services to organisations in the EU, Trendspek's data processing activities must adhere to the GDPR and is regulated by the ICO. The GDPR, in relation to Trendspek's processing of PII of individuals requires Trendspek to observe particular attention to the consent of individuals, and more generally, the rights of individuals as detailed in the section 'Your Right Under the GDPR' shown below.

Trendspek’s Precision Asset Intelligence (PAI) software combines the next generation in Rapid Asset Capture, with intuitive software that delivers the most detailed models in the world – Precision Reality Twins (PRT). Accordingly, Trendspek processes customer data to help its partners evaluate and manage their assets more effectively and efficiently.

We may use third-party Service providers to monitor and analyze the use of our Service.
Google Analytics
Google Analytics is a web analytics service offered by Google that tracks and reports website traffic. Google uses the data collected to track and monitor the use of our Service. This data is shared with other Google services. Google may use the collected data to contextualize and personalize the ads of its own advertising network.
You can opt-out of having made your activity on the Service available to Google Analytics by installing the Google Analytics opt-out browser add-on. The add-on prevents the Google Analytics JavaScript (ga.js, analytics.js and dc.js) from sharing information with Google Analytics about visits activity.

4.2 Email Marketing
We may use Your Personal Data to contact You with newsletters, marketing or promotional materials and other information that may be of interest to You. 4.3 De-identified Information
We may use your Personal Information in de-identified form (de-identification being a process by which a collection of data or information is altered to remove or obscure personal identifiers and personal information) to assist us in running our business. We may also provide, including by way of sale, de-identified data and/or information in aggregated form, to third parties. This data and/or information may include (but is not limited to):
- Measurement statistics;
- Trends in property, land and other subject characteristics;
- Characteristics of property and other subjects;
- Such other data and information that is collected via the Online Platform and/or Services and is not capable of identifying you.
When your Personal Information is included in de-identified, aggregated data, it is not possible to identify you or anything about you from that data.
5. GDPR Privacy
5.1 Legal Basis for Processing Personal Data under GDPR
We may process Personal Data under the following conditions:
- Consent: You have given Your consent for processing Personal Data for one or more specific purposes.
- Performance of a contract: Provision of Personal Data is necessary for the performance of an agreement with You and/or for any pre-contractual obligations thereof.
In any case, the Company will gladly help to clarify the specific legal basis that applies to the processing, and in particular whether the provision of Personal Data is a statutory or contractual requirement, or a requirement necessary to enter into a contract.
